Research on the Bona Fide Protection in Intellectual Property Transaction

Abstract

The traditional system of bona fide acquisition in civil law plays an important role in the transaction of real right in our country. As long as it conforms to the constitutive requirements of bona fide acquisition, the change of real right will occur between the original owner and the bona fide third party. In our country, the object of intellectual property has the characteristics of invisibility, which is similar to the object of real right in essence, so it is feasible to apply the system of bona fide acquisition in the field of intellectual property. This paper mainly analyzes the bona fide protection of intellectual property rights from the current situation, problems and the future development of the system of bona fide acquisition of intellectual property rights, and puts forward suggestions for the improvement of the system of bona fide protection in intellectual property transactions, which can provide some reference for the improvement of relevant laws and regulations concerning intellectual property rights.
