Research on Whole-chain Criminal Law Regulation of Doxxing-Style Cyber Violence

Abstract

As a new form of cyber violence, doxxing-style cyber violence forms a complete black industrial chain by illegally obtaining and disclosing citizens' personal information and triggering secondary infringements, which seriously infringes on citizens' right to personal information and personality rights, and disrupts the order of cyberspace. Combined with relevant cases, criminal law provisions and judicial interpretations, after sorting out its whole-chain characteristics, it is found that the current criminal law regulation faces dilemmas such as obstacles to the application of miscellaneous provisions, vague responsibilities of multiple subjects, and lack of prevention and control mechanisms. Based on the principle of criminal law modesty and the principle of legality of crimes and punishments, we should optimize the application of charges, clarify the boundaries of responsibilities, and improve the prevention and control mechanisms to build a whole-chain criminal law regulation system, realize precise regulation and source prevention and control, balance the protection of citizens' rights and interests, cyberspace governance and the punishment function of criminal law, and create a healthy cyber ecology.
